Renovation delayed, the final invoice is significantly higher than expected presupuesto or an online parcel never turns up - conflicts over consumer rights are also part of everyday life between Dénia, Benidorm, Torrevieja and La Zenia. Not every case is fraud. Often it is a lack of agreements, time pressure or organisational shortcomings. The key is to act in a structured and verifiable manner.

Documentation: your most important safeguard
No action without receipts. Save:

  • written cost estimates (presupuesto)
  • Invoices (factura con IVA)
  • Proof of payment
  • Email and chat histories
  • Photos of the performance status or defects

Significant price deviations are not permitted without a written basis. A detailed breakdown may be requested. Disputed amounts may be withheld until clarification.
A reputable company has a CIF tax number and issues a proper invoice with VAT shown.

Hoja de Reclamaciones: compulsory instrument in the region
In the entire Comunitat Valenciana - that is, from the Marina Alta to the Vega Baja - is the Hoja de Reclamaciones prescribed by law.
Any business that sells goods or services to consumers must:

  • have official complaint forms available,
  • visibly point this out,
  • hand them over immediately upon request.

The complaint is then submitted to the local OMIC (Oficina Municipal de Información al Consumidor) or directly to the regional consumer protection authority.
If you refuse to hand over the documents, this is an administrative offence that can be sanctioned.

Online purchase: set a deadline, secure payment
If a delivery fails to materialise, the retailer should be contacted in writing and a clear deadline for delivery or repayment should be set (usually seven days).
If there is no response, a chargeback procedure can be initiated via credit card providers or payment service providers. If fraud is suspected, the Guardia Civil - in particular the cybercrime department - will accept reports.

Display as the last step
If an out-of-court settlement fails, a denuncia with the Policía Local or Guardia Civil can be useful - especially to legally secure larger claims.

Prevention in everyday life

  • Do not pay in full in advance.
  • Check references, address and tax number.
  • Only pay via secure websites (https).
  • Agree instalment payments.
  • Complain about defects in writing at an early stage.
